The WTTA (Dutch: Wet Toelating Terbeschikkingstelling Arbeidskrachten) has been approved by the Dutch Senate. The WTTA is introducing a mandatory regime for agencies and companies that hire out employees. The purpose of the WTTA is to strengthen the protection of (highly skilled) labour migrants, for instance against unfair practices such as underpayment of working under poor conditions.

Key points:

  • Payrolling companies and temp agencies must be registered with the Dutch Labour Lending Authority (NAU) per 01 January 2027.
  • A security deposit must be paid by these companies.
  • The new legislation will come into effect as of 1 January 2027.
  • Monitoring by authorities will start as of 1 January 2028.
  • Non-compliance will be penalised, this applies to the payrolling companies and temp agencies, but also recipients that hire employees from non-registered companies.

Impact for hiring companies:

  • Hiring companies must ensure that the payrolling company they use is registered with the NAU. Otherwise they can be penalised.
